You can report this to the anti virus developers as false postitive. Or you can buy a code signing certificate and sign the .exe

This problem has been tested again and again. There will be no virus alarm when using driect3d when it is released, but it will be given an alarm if OpenGL is used.

As Erik said, it's a "false positive" with the Anti-virus.
Niko would not be able to fix this, and shouldn't be expected to.
Contact your antivirus provider to help them to flag false-positives - or simply use a different Antivirus with better detection algorithms.
